If exhaustion of administrative remedies isn’t enough to put you to sleep, wait until you understand what it means. If your insurance claim has been denied by the claims adjuster, you have to go back to them and ask them to reconsider. You have to go back to the people that just denied your claim and ask them to overturn their own decision of denying your claim. Usually, under ERISA, you have to go through that process twice. Once they’ve denied your claim twice, you are more than likely going to find yourself in federal court. If you have an ERISA claim, in between those two decisions is when your trial may be occurring. Don’t go to trial without an attorney. Don’t try to appeal your claim without a lawyer. Don’t exhaust administrative remedies without someone on your team.
